Terms of Service

1. Agreement and authority

These Terms are an agreement between you and Nonsen Production ("Nyx," "we," or "us") governing the Nyx Discord bot, nyxbot.app, dashboard, API and related services (the "Service"). By installing, accessing, purchasing or using the Service, you agree to these Terms and the Privacy Policy. If you act for an organization or Discord server, you confirm that you have authority to bind it. If you do not agree, do not use the Service.

2. Eligibility and accounts

You must be permitted to use Discord, meet Discord's minimum age for your country, and be legally able to agree to these Terms. If you cannot form a binding agreement, a parent or legal guardian must agree for you where permitted by law. Keep your Discord account, sessions, API credentials and connected-service credentials secure. You are responsible for activity authorized through them and must promptly report suspected compromise.

3. The Service

Nyx provides Discord automation, AI conversation, music, moderation, scheduling, knowledge-base, integration and dashboard features. Features and limits may depend on plan, server permissions, region and third-party availability. Server administrators choose configurations, permissions, custom prompts, integrations and enforcement settings, and are responsible for telling members how those choices affect their community.

4. Your content and instructions

You keep ownership of content you submit. You give Nyx a worldwide, non-exclusive, royalty-free license to host, reproduce, process, transmit and display that content only as needed to provide, secure and support the Service. You confirm that you have the rights and permissions needed to submit the content and connect any account, calendar, document, server or tool. Do not submit secrets or sensitive personal data unless the feature requires it and you are legally permitted to do so.

5. Acceptable use

You must not use the Service to:

• break any law or another person's rights;
• harass, exploit or endanger anyone, or distribute unlawful, infringing or malicious content;
• access accounts, systems or data without authorization, introduce malware, or disrupt the Service;
• bypass permissions, safety controls, rate limits, plan limits or enforcement, including through multiple accounts;
• scrape, reverse engineer or automate access except through documented interfaces or where law expressly permits it;
• use Discord data for advertising, surveillance, unlawful discrimination or eligibility decisions; or
• present AI output as human-authored where that would deceive or harm others.

You must also follow Discord's terms and policies and the terms of each connected service.

6. AI, moderation and safety

AI output may be inaccurate, incomplete, offensive or unsuitable. It is not legal, medical, financial or other professional advice. Review output before relying on it, especially for consequential decisions. Do not use Nyx to make decisions about employment, housing, credit, insurance, healthcare or legal rights.

Automated moderation can log content, delete messages, warn, timeout, kick or ban members according to administrator settings. Nyx does not guarantee that moderation will detect every violation or avoid every false positive. Server administrators remain responsible for their rules, settings, notices, human review and appeals. Members should contest a decision with that server's administrators.

7. Third-party services

The Service depends on Discord and may interact with OpenAI, Google, Stripe, music providers and integrations or MCP servers you connect. Their terms and privacy policies govern their services. Nyx is not responsible for third-party content, policies, outages or actions. Disconnect an optional integration if you no longer want Nyx to access it.

8. Premium, renewal and refunds

Prices, billing interval, included features and taxes are shown before purchase. Paid subscriptions automatically renew for the same interval until cancelled. Stripe processes payment details. You authorize recurring charges until cancellation and must keep billing information current. Cancel through the billing portal before renewal to stop future charges; access normally continues through the paid period.

Except where law requires otherwise or the checkout offer expressly says otherwise, payments are non-refundable and partial periods are not prorated. We may change future prices or plan features with reasonable advance notice; the change applies from a later renewal. Mandatory cancellation, cooling-off, refund and consumer rights remain unaffected.

9. Nyx intellectual property

Nyx and its licensors own the Service, software, design, branding and documentation, excluding your content and third-party materials. Subject to these Terms, we give you a limited, revocable, non-exclusive, non-transferable right to use the Service. No other rights are granted. Feedback may be used without restriction or payment, without identifying you publicly.

10. Suspension and termination

You may stop using Nyx, remove it from a server and cancel a paid plan at any time. We may limit, suspend or terminate access when reasonably necessary for security, legal compliance, non-payment, material or repeated breach, harm to users or the Service, or discontinuation. Where practical, we will provide notice and an opportunity to cure. Provisions that by nature should survive, including ownership, disclaimers, liability and dispute terms, survive termination.

11. Availability and disclaimers

We aim to provide a reliable Service but do not promise uninterrupted, error-free, secure or permanent availability. Features may change or be discontinued. To the fullest extent permitted by law, the Service is provided "as is" and "as available," without implied warranties of merchantability, fitness for a particular purpose, non-infringement or accuracy. Nothing in these Terms excludes a warranty or right that applicable law does not allow us to exclude.

12. Limitation of liability

To the fullest extent permitted by law, Nyx and Nonsen Production will not be liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, revenue, data, goodwill or business interruption. Our total liability arising from the Service will not exceed the greater of US$100 or the amount you paid Nyx in the six months before the event giving rise to the claim.

These limits do not apply to fraud, willful misconduct, gross negligence, death or personal injury caused by negligence, or any liability that cannot lawfully be limited. Some jurisdictions do not allow certain exclusions, so they apply only to the extent lawful.

13. Indemnity

If you use Nyx for a business or administer a Discord server, you will defend and indemnify Nonsen Production against third-party claims and reasonable costs resulting from your unlawful content, custom prompts, server rules, integration instructions, or material breach of these Terms. This does not apply to the extent a claim was caused by Nyx, or where prohibited by consumer law.

14. Governing law and disputes

These Terms are governed by the laws of Thailand, without regard to conflict-of-law rules. Before filing a claim, contact us and allow 30 days for a good-faith attempt to resolve it. Subject to any mandatory right to bring a claim elsewhere, the courts of Thailand have jurisdiction. Nothing in these Terms limits mandatory consumer protections or your right to seek urgent injunctive relief.

15. Changes and general terms

We may update these Terms as the Service or law changes. We will update the date above and give reasonable advance notice when a material change affects paid service or your rights. Continued use after the effective date means you accept the revised Terms; if you do not, stop using the Service and cancel before renewal.

These Terms and the Privacy Policy are the entire agreement about the Service. If a provision is unenforceable, it will be limited only as necessary and the rest remains effective. Failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them as part of a merger, reorganization or sale, subject to applicable law.
